1. Agreement to Terms

By accessing or using Frankly ("the Service"), operated at withfrankly.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Frankly is an anonymous feedback platform that allows organizations to share updates and collect anonymous responses from their teams. The Service includes post creation, anonymous response submission, file uploads, and organizational collaboration features.

3. Accounts

To create posts and manage responses, you must create an account. You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account.

Responding to posts does not require an account. Anonymous respondents are identified only by a browser cookie for the purpose of preventing duplicate submissions.

4. Acceptable Use

You agree not to:

  • Use the Service to harass, abuse, or threaten others
  • Submit content that is illegal, defamatory, or violates the rights of others
  • Attempt to circumvent anonymity protections to identify respondents
  • Use automated tools to submit spam responses or manipulate voting
  • Upload files containing malware or malicious content
  • Interfere with or disrupt the Service infrastructure

5. Content

You retain ownership of content you create on the Service. By posting content, you grant Frankly a non-exclusive, worldwide license to host, display, and distribute that content as part of providing the Service.

Anonymous responses are submitted without attribution. Once submitted, anonymous responses cannot be attributed back to a specific individual by the Service.

6. Organizations

Organization owners and administrators are responsible for managing their organization's members and content. Inviting a member grants them access to view all responses (including private ones) and reply on behalf of the organization.

7. File Uploads

The Service allows uploading images and PDF files. You are responsible for ensuring you have the right to upload any files. Files are stored on third-party infrastructure and are accessible via their URLs. We may impose size limits and file type restrictions.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon account deletion, your posts and associated data will be removed.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Frankly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.
